Terms of Service

1. Acceptance of Terms

Welcome to Food A+ Plus. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Food A+ Plus, Inc. ("Food A+ Plus," "we," "us," or "our") governing your access to and use of the Food A+ Plus website, mobile applications, and all related services (collectively, the "Platform").

By accessing, browsing, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must discontinue use of the Platform immediately.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least thirty (30) days prior to taking effect. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

2. Eligibility

The Platform is intended for use by individuals who are at least eighteen (18) years of age or the age of legal majority in their jurisdiction, whichever is greater. By creating an account or using the Platform, you represent and warrant that you meet these age requirements and have the legal capacity to enter into a binding agreement.

If you are using the Platform on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, "you" and "your" shall refer to both you individually and the entity you represent.

We reserve the right to refuse service, terminate accounts, or restrict access to the Platform at our sole discretion, including but not limited to cases where we reasonably believe that a user does not meet these eligibility requirements or has violated these Terms.

3. Account Registration

To access certain features of the Platform, including submitting reviews, saving favorite dishes, and managing restaurant profiles, you must create an account. When registering, you agree to provide accurate, current, and complete information and to update such information promptly to keep it accurate and complete.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to notify us immediately at hello@foodaplus.com of any unauthorized use of your account or any other security breach. Food A+ Plus will not be liable for any loss or damage arising from your failure to protect your account credentials.

You may not create multiple accounts for deceptive purposes, use another person's account without authorization, or sell, transfer, or assign your account to any third party. We reserve the right to suspend or terminate accounts that we believe, in our sole discretion, violate these provisions.

4. User Content & Reviews

The Platform allows you to submit reviews, ratings, photographs, comments, and other content ("User Content"). You retain ownership of your User Content; however, by submitting User Content to the Platform, you grant Food A+ Plus a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and create derivative works from your User Content in connection with operating and promoting the Platform.

You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not infringe upon or violate the intellectual property rights, privacy rights, or any other rights of any third party. You further represent that your User Content is truthful, based on genuine personal experience, and does not contain any false, misleading, or defamatory statements.

Food A+ Plus does not endorse, verify, or assume responsibility for any User Content. We reserve the right, but are not obligated, to monitor, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms, our community guidelines, or applicable law.

5. Reviews Policy

Reviews are the cornerstone of the Food A+ Plus experience. Our proprietary rating system assigns grades of A+, A, or B to dishes and restaurants based on aggregated user reviews and expert evaluations. To maintain the integrity and trustworthiness of our ratings, all reviews must comply with the following guidelines.

Reviews must reflect genuine, first-hand dining experiences. You may not submit reviews for establishments you have not personally visited or for dishes you have not personally consumed. The following content is strictly prohibited in reviews:

  • False, fabricated, or misleading statements about a dish, restaurant, or dining experience
  • Reviews submitted in exchange for payment, free meals, discounts, or any other form of compensation
  • Reviews intended to artificially inflate or deflate a restaurant's rating
  • Content that is obscene, threatening, harassing, discriminatory, or otherwise objectionable
  • Personal information about restaurant staff or other diners without their consent
  • Spam, promotional content, or links to external websites unrelated to the dining experience

Food A+ Plus employs automated systems and manual review processes to detect and remove inauthentic reviews. Users who violate our Reviews Policy may have their reviews removed, their accounts suspended, or their access to the Platform permanently revoked. We also reserve the right to adjust ratings that have been artificially manipulated.

6. Restaurant Listings

Food A+ Plus provides information about restaurants, including menus, hours of operation, locations, and user-generated reviews and ratings. While we make reasonable efforts to ensure the accuracy of restaurant listing information, we do not guarantee that such information is complete, current, or error-free. Restaurant details, including menu items, pricing, and hours, are subject to change without notice and are the sole responsibility of the respective restaurant.

Restaurants that participate in our A+ Certified program have met specific quality standards as determined by our evaluation criteria. However, an A+ Certification does not constitute a warranty or guarantee of food quality, safety, or service. Diners should exercise their own judgment when selecting a restaurant and should direct any concerns about food safety or quality directly to the restaurant or relevant health authorities.

If you are a restaurant owner or authorized representative, you may claim and manage your restaurant's listing on the Platform by creating a business account. You are responsible for ensuring that all information you provide about your establishment is accurate, current, and compliant with applicable laws and regulations.

7. Payments & Transactions

Certain features of the Platform, including premium subscriptions, A+ Certified restaurant services, and promotional placements, may require payment. All fees are stated in U.S. dollars unless otherwise indicated and are non-refundable except as expressly provided in these Terms or as required by applicable law.

Payment processing is handled by third-party payment processors. By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize Food A+ Plus and its payment processors to charge the applicable fees. You are responsible for all taxes associated with your use of paid services on the Platform.

For subscription services, your subscription will automatically renew at the end of each billing cycle unless you cancel prior to the renewal date. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to paid features until that time. Food A+ Plus reserves the right to change its pricing at any time, with thirty (30) days' prior notice for existing subscribers.

8. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

We encourage you to read the Privacy Policy carefully to understand how we handle your personal data, including information about your browsing behavior, location data, review history, and account information. You acknowledge that no method of transmission over the internet or method of electronic storage is completely secure, and while we implement commercially reasonable security measures, we cannot guarantee the absolute security of your personal information.

9. Intellectual Property

The Platform and its entire contents, features, and functionality, including but not limited to the Food A+ Plus name, logo, rating system, A+ Certified designation, design elements, text, graphics, software, photographs, video, and audio (collectively, "Platform Content"), are owned by Food A+ Plus, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Platform Content without our prior written consent, except as incidental to normal web browsing.

The Food A+ Plus trademarks, service marks, and logos may not be used in connection with any product or service that is not affiliated with Food A+ Plus, in any manner that is likely to cause confusion among consumers, or in any manner that disparages or discredits Food A+ Plus. All other trademarks not owned by Food A+ Plus that appear on the Platform are the property of their respective owners.

10. Termination

You may terminate your account at any time by contacting us at hello@foodaplus.com or through your account settings. Upon termination, your right to access and use the Platform will cease immediately. We may retain certain information as required by law or for legitimate business purposes, as described in our Privacy Policy.

Food A+ Plus reserves the right to suspend or terminate your account, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Grounds for termination include, but are not limited to: submitting fraudulent or inauthentic reviews, engaging in harassment or abusive behavior toward other users or restaurant staff, attempting to manipulate ratings, creating multiple accounts, or violating any applicable law or regulation.

Upon termination, all provisions of these Terms that by their nature should survive will survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability. Any User Content you have submitted prior to termination may remain on the Platform at our discretion.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOOD A+ PLUS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

FOOD A+ PLUS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. FOOD A+ PLUS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE PLATFORM IN TERMS OF ACCURACY, RELIABILITY, OR OTHERWISE.

The ratings, reviews, and recommendations provided on the Platform are based on subjective user opinions and do not constitute professional advice. Food A+ Plus does not guarantee the quality, safety, or legality of any restaurant, dish, or food product listed on the Platform. Any reliance you place on information available through the Platform is strictly at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOOD A+ PLUS, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF FOOD A+ PLUS FOR ALL CLAIMS RELATING TO THE PLATFORM EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID TO FOOD A+ PLUS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the above exclusions and limitations may not apply to you. In such jurisdictions, the liability of Food A+ Plus shall be limited to the greatest extent permitted by applicable law. Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
